1 Acceptance of Terms

By enrolling in courses, making fee payments, or using the website and training facilities of Maria MDS (Motor Driving School), a government-registered driving academy under Kerala Motor Vehicles Department (RTO License No: KL-31/MDS/2014) in Kayamkulam, Kerala, you accept and agree to be legally bound by these Terms and Conditions.

These terms govern your training schedule, vehicle usage, road safety standards, payment transactions, and regulatory coordination with the Kerala Motor Vehicles Department (KL-31 Sub RT Office Kayamkulam).

2 Service Description & Curriculum

Maria MDS provides certified motor vehicle driver training structured in accordance with Central Motor Vehicles Rules and Kerala MVD syllabi, comprising:

• Practical Four-Wheeler Instruction: Behind-the-wheel lessons conducted on certified dual-control vehicles with experienced instructors.
• Ground Maneuver Training: Intensive practice for Kerala RTO test track maneuvers, specifically the Reverse 'H' track for cars and the '8' figure track for two-wheelers.
• Two-Wheeler Riding Lessons: Structured clutch, gear, and balance training for geared motorcycles and scooters.
• Highway & Night Orientation: Defensive driving modules covering highway overtaking, roundabouts, night visibility, and hazard perception.
• Licensing Support: Administrative coordination for Learner's License (LLR) applications, Form 1A medical verification, and RTO KL-31 driving test slot scheduling.

3 Payment Processing & Fees

All course fee payments are processed securely through certified Indian payment gateways (such as PhonePe), direct UPI, net banking, or directly at our office desk:

• Fee Schedule: Course fees must be paid in full or as per agreed installment milestones prior to commencement of training phases.
• Official Receipts: A formal stamped receipt or electronic confirmation is issued for every transaction.
• PhonePe Integration: Online transactions are handled directly through PhonePe's secure gateway. We do not store sensitive payment card information or banking passwords.
• Government Fees: Official RTO charges (e.g. Parivahan test booking fees, LLR fees) are statutory government remittances and are non-refundable once filed.

Safe driving instruction requires strict discipline. As an enrolled student, you agree to:

5 Eligibility Requirements

To register for training and obtain Kerala RTO (KL-31) test clearance, applicants must fulfill:

• Age Requirement: Minimum 18 years for Light Motor Vehicle (LMV / Car) and Geared Two-Wheelers; minimum 16 years for gearless scooter (with written parent/guardian consent).
• Medical Fitness: Must satisfy physical and visual acuity fitness requirements (Form 1 / Form 1A medical declaration).
• Identification: Must provide legitimate government-issued identity and residence proofs as mandated by the Motor Vehicles Department.

6 Intellectual Property

All curriculum outlines, highway companion road layouts, signage guides, and educational materials produced by Maria MDS are protected under Indian intellectual property laws. Content may not be duplicated, sold, or distributed for commercial purposes without prior written authorization.

7 Privacy & Data Protection

Your personal information, driving records, and RTO documentation are governed by our Privacy Policy, which forms an integral part of these terms. We apply industry-standard security safeguards to protect your records.

8 Limitation of Liability & Test Outcomes

Maria MDS training vehicles are fully insured and fitted with safety dual-control pedals inspected per RTO guidelines. While we maintain a 98.4% first-attempt success rate through dedicated coaching, the ultimate evaluation and issuance of a permanent Driving License is determined solely by the Motor Vehicle Inspector (MVI) of the Kerala Motor Vehicles Department.

Maria MDS shall not be held liable for test anxiety, failure to appear at scheduled RTO test times, or independent driving infractions committed outside instructed school sessions. In all circumstances, total school liability is limited to the course fees received for that specific student.

9 Lesson Rescheduling & Weather Contingencies

In cases of severe monsoon waterlogging, severe weather warnings, or Kerala MVD test ground closures, Maria MDS will reschedule sessions at zero additional cost to ensure student safety. Students may reschedule lessons with 24 hours prior notice to our desk.

10 Termination of Services

Maria MDS reserves the right to suspend or terminate training services if a student violates vehicle safety rules, exhibits abusive or dangerous behavior toward instructors or fellow learners, or defaults on agreed installment payments. Termination for gross safety misconduct forfeits remaining session fees.

11 Governing Law & Jurisdiction

These terms are governed by the laws of Kerala, India. Any disputes arising out of these terms, student enrollments, or training services shall fall under the exclusive jurisdiction of the competent courts in Kayamkulam / Alappuzha District, Kerala.

12 Amendments to Terms

We may update these terms to incorporate changes in RTO directives, road laws, or digital payment processing standards. Continued participation in driving training following modifications constitutes acknowledgment and acceptance of the updated terms.
